We (Tourscheck) as an online service, provide users options to search, filter, check and book tours, excursions and activities all around the world through our website, any affiliated websites as well as Tourscheck Applications. When you book or review our services, we provide your information to the necessary third party Travel Providers and distributors who manage the hosting, purchase and payment for our products and services.

If you provide information directly to our affiliates, distributors or suppliers, the terms of their respective Privacy Policies, and not this Privacy Policy, will apply. If any part of any Tourscheck website links you to other websites, those external websites do not operate under this Privacy Policy. You should carefully review the Privacy Policies of the affiliate partner, distributor or supplier prior to providing information to such third parties as we are not responsible for the privacy practices of other sites.

Data We Collect

When you register with Tourscheck, we ask for your basic information including your name, email address and other Information. You can choose not to provide information to us, but in general some information about you is required in order to purchase products or services. It is necessary for you to disclose Personal Information, including your name, email address, phone number, credit card details and other personally identifying information. If you do not provide Personal Information when purchasing one of our supplier's products or services, we cannot confirm your purchase or process your booking.

Personal Data

Personal data is specific information about personal or factual circumstances regarding and identified natural person, including information such as name, address, email address, phone number, user name and password and billing information (such as your credit card number, cardholder name, and card expiration date).

Personal data processed may not be transferred to a country outside the European Economic Area without the prior written consent of the Data Controller. If personal data processed is transferred from a country within the European Economic Area to a country outside the European Economic Area, the Parties shall ensure that the personal data are adequately protected. To achieve this, the Parties shall, unless agreed otherwise, rely on EU approved standard contractual clauses for the transfer of personal data

Automatic Data Collection

When you visit Tourscheck.com we collect data necessary to enable your use of this website, such as IP address, identification data (your login details), content viewed, pages visited and product searches. Also if you subscribe to our newsletters it is necessary to collect some of your personal data such as your email.

Tourscheck may keep track of how you interact with links across our Services, including our email notifications, third-party services, and client applications, by redirecting clicks or through other means. We do this to help improve our Services, and to be able to share aggregate click statistics such as how many times a particular link was clicked on.

Web Trackers

If using our mobile Applications or access one of our websites optimized for mobile devices, we may collect information about you and your mobile devices(s). Data Collected Upon Registration

When you create or amend a User account you provide some personal information, such as your name, username, password, email address, phone number, address, city and country. When you make a booking on the Tourscheck website or Applications an account will automatically be created for you. You account allows you to view, change or cancel your bookings, and may include features that allow you to connect with other travelers, leave reviews, upload photos, share travel tips and plan future trips. After making your first booking on the Tourscheck you will receive details of your Tourscheck account username and password. You can change your username, password and personal details at any time by logging into your account. Your review settings in your Tourscheck account will automatically default to showing your profile photo and username for your reviews. You can modify this profile setting at any time by logging into your account. Where you have chosen not to show your profile photo and name with your reviews, any reviews that you submit will show your tour, excursion or activity only.

Payment Information

If you book a tour, excursion or activity through Tourscheck website or Applications, we do not collect payment information from you, including your credit card number, cardholder name, expiration date, authentication code, and billing address, instead we are using third-party payment gateways such as Stripe, Pay Pal, Union Pay which will require your credit card number, cardholder name, expiration date, authentication code, and billing address for your booking and reservation to be processed.

Your Account

Using your Account on Tourscheck website and Applications enables you to post reviews of the tours, excursions and activities you book, upload photos and filling out your public profile. We may publicly display them on our websites and Applications and those of our affiliate partners and distributors, display them to other users, share them with our affiliate partners and distributors, and use them for promotional purposes. Note that if you include Personal Information in your Account, it can be used and viewed by others. We are not responsible for the information you choose to include in your Account.

We work with our advertising partners in order to try and ensure that when you see an advert for a Tourscheck brand it will be relevant to you and your interests. This applies to adverts that are displayed on Tourscheck’s own websites (including the Tourscheck Sites, in Tourscheck emails, and on websites owned by third parties). Use of Data for Marketing Purposes

In addition to the general data usage use which is required when you use our travel related and data processing services, we use your email address for sending confirmation of your bookings, pre-trip reminder e-mails, an email reminder to provide a guest review of your last tour, excursion or activitiey. Our booking confirmation and pre-trip reminder emails may contain banner advertising. We only use your phone number to contact you urgently if there is a problem with your booking. In circumstances where you contact us with a query, we use your contact details in order to respond to your query.

We will provide you with choices regarding the use and disclosure of your Personal Information for marketing purposes. Where you have given us your consent, we may send you emails that we think will be useful to you. They also will comply with applicable laws governing the transmission of promotional communications and, at a minimum, give you an opportunity in any commercial email we send to choose not to receive such email messages in the future. You may unsubscribe at any time by following the directions and link included in each email marketing message we send. You may email us (customer.service@tourscheck.com) and request to be unsubscribed by including your name, email address, and the words "unsubscribe" in the subject or body of email.

Our marketing emails may include following : e-newsletter, special offers, travel tips, customer surveys and information about products and services offered by us or our selected partners. Where your settings on your device permit us to send Application notifications we may also send you Application notifications containing similar information. If you email us, we may keep your message, email address and contact information to respond to your request. The other service may send us your registration or profile information on that service and other information that you authorize.

Please note that, even if you opt-out of receiving future marketing emails from Tourscheck, we will continue to send to you emails regarding your purchases and bookings, and regarding changes to our terms and policies.

We would not sell or rent your personal information to third parties for their marketing purposes without your prior consent.

Shared Data With Affiliates, Distributors and Suppliers

Tours, excursions and activities promoted on our website and Applications are created and made available by our third-party affiliates, distributors and suppliers. Some of our affiliates, distributors and suppliers may need additional Information (age limitations, health condition, physical fitness level, special clothing/weather requirements) to determine whether you can participate in a tour, excursion or activity with out any limitations. We only provide our affiliates, distributors and suppliers with your name and your contact details. We do not provide them any other Personal Information. If you decide to provide any Personal Information directly to our affiliates, distributors and suppliers, we recommend that you review respected affiliates, distributors and suppliers Privacy Policy which may defer to our Privacy Policy.

Shared Data With Other Third-Parties

In order to manage and operate our website and Applications we use the services of various Third-Party companies which operate on our behalf in terms of legal advising, payment processing, customer service, marketing and analytics. Third-party companies have access to and may collect information only as needed to perform their obligations necessary for our website and Applications to function. Third-Party companies are not permitted to share or use the information for any other purpose.

Law and Harm

Notwithstanding anything to the contrary in this Privacy Policy, we may preserve or disclose your information if we believe that it is reasonably necessary to comply with a law, regulation or legal request; to protect the safety of any person; to address fraud, security or technical issues; or to protect Tourscheck.com rights or property. However, nothing in this Privacy Policy is intended to limit any legal defenses or objections that you may have to a Third-Parties, including a governments, request to disclose your information.

Transfer of Personal Data

In the event that Tourscheck Inc. is involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, your Information will not be shared, sold or transferred unless you have previously given your consent. Transfers of data to government institutions and authorities is done only within scope of mandatory legal requirements. Our employees and partners are obliged by us to maintain secrecy and to comply with legal data protection regulations.

Data Storage and Protection

As Data Controller (We/Tourscheck) will protect and manage storage and security of your Personal Information, using Secure Socket Layer (SSL), storing Data not accessible to general public and security measures in our physical locations. Your personal Information will be stored for only as long as necessary for the purposes stated in this Privacy Policy or for as long as we are obliged to store this information by law.

As the performance of the Agreement and the delivery of the Services implies the processing of personal data, the Data Controller (We/Tourscheck) and the Data Processor (Travel Provider) shall comply with the applicable data protection legislation and regulations and protect security of your Personal Information. The Data Processor shall ensure that in relation to personal data disclosed to it by, or otherwise obtained from the Data Controller, it shall act as the Data Controller’s data processor in relation to such personal data and shall therefore:

1.  From 25th of May 2018, create and maintain a record of its processing activities in relation to this Agreement; the Data Processor shall make the record available to the Data Controller, any auditor appointed by it and/or the supervisory authority on first request;

2.  Not process the personal data for any purpose other than to deliver the Services and to perform its obligations under the Agreement in accordance with the documented instructions of the Data Controller; if it cannot provide such compliance, for whatever reasons, it agrees to promptly inform the Data Controller of its inability to comply;

3.  Inform the Data Controller immediately if it believes that any instruction from the Data Controller infringes applicable data protection legislation and regulations;

4.  Not disclose the personal data to any person other than to its personnel as necessary to perform its obligations under the Agreement and ensure that such personnel is subject to statutory or contractual confidentiality obligations;

5.  Take appropriate technical and organizational measures against any unauthorized or unlawful processing, and to evaluate at regular intervals the adequacy of such security measures, amending these measures where necessary; these security measures are described in Schedule 2.

6. Ensure that access, inspection, processing and provision of the personal data shall take place only in accordance with the need-to-know principle, i.e. information shall be provided only to those persons who require the personal data for their work in relation to the performance of the Services;

7.  Promptly notify the Data Controller about (i) any legally binding request for disclosure of the personal data by a data subject, a judicial or regulatory authority unless otherwise prohibited, such as the obligation under criminal law to preserve the confidentiality of a judicial enquiry, and to assist the Data Controller therewith (ii) any accidental or unauthorized access, and more in general, any unlawful processing and to assist the Data Controller therewith;

8.  Deal promptly and properly with all reasonable inquiries from the Data Controller relating to its processing of the personal data or in connection with the Agreement;

9.  Make available to the Data Controller all information necessary to demonstrate compliance with the applicable data protection legislation and regulations;

10.  At the request and costs of the Data Controller, submit its data processing facilities for audit or control of the processing activities;

11.  Refrain from engaging another data processor without the prior written consent of the Data Controller;

12.  Assist the Data Controller, subject to reasonable additional compensation, with the Data Controller’s obligation under applicable data protection laws and regulations.;

Please note that no data on the Internet or physical data storage can be guaranteed to be 100% secure and safe. For that reason we cannot give an absolute assurance that the information you provide to us will be secure and safe at all times. Please notify us if you experience any unusual situations that may indicate a breach in your information security, and will investigate whether the security breach was related to the data transmissions from or to Tourscheck and let you know what steps can be taken and have been taken to help to solve the problem.

Access, Amendment and Deletion Rights

We take reasonable steps to ensure that your information is relevant to its intended use, and that it is accurate and up to date. As a registered Tourscheck user, you can access and update your contact information, personal preferences and e-mail subscription choices at any time by visiting the account section of the www.tourscheck.com.

If you are a registered user of our Services, we provide you with tools and account settings to access or modify the personal information you provided to us and associated with your account.

You can also permanently delete your Tourscheck.com account. When your account is deactivated, it is not viewable on the Site. For up to 30 days after deactivation it is still possible to restore your account if it was accidentally or wrongfully deactivated. After 30 days, we begin the process of deleting your account from our systems, which can take up to a week.
